Notwithstanding anything contained elsewhere in this Act, the following projects shall not be implemented through public-private partnership:-
(a) A project conducted with the objective of obtaining any work or service from the private sector without transferring the financial, technical or operational risk to the private sector,
(b) Projects related to national security,
(c) Other projects as may be prescribed by the Board.
